Welcome to zapfood. These Terms of Service govern the use of our restaurant management platform by business users (restaurants and their staff). By accessing or using the Service, you agree to be bound by these terms. Please read them carefully.
To use our Service, you must create an account and provide accurate business information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
zapfood provides a restaurant management platform including online ordering (delivery, pickup, and dine-in), payment processing through multiple providers, real-time order tracking, multi-language support, loyalty programs, promotional codes, EU VAT compliance, analytics and reporting, and administrative tools for managing your restaurant business.
Our pricing is available on our website. Subscription fees are billed in advance and processed through Stripe. Order payments from your customers may be processed through Stripe, Paytrail, or Visma Pay depending on your configuration. Prices may be subject to change with reasonable advance notice.

The Service and its original content, features, and functionality are owned by zapfood and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of all content and data you upload to the Service, including menus, product information, and business data. Customer order data is jointly controlled. You may export your data at any time through the platform's export features. Upon termination, we will make your data available for export for a reasonable period before deletion.
The Service is provided on an "as available" basis. zapfood does not guarantee any specific level of uptime, availability, performance, or response time. Unless a separate, signed Service Level Agreement (SLA) exists between zapfood and You, no uptime commitments of any kind apply.
zapfood shall not be liable for any compensation, damages, or losses arising from: planned or unplanned service downtime, outages, or interruptions; reduced performance, latency, or degraded functionality; software bugs, errors, defects, or unexpected behavior; data synchronization delays or failures; incompatibility with your hardware, software, browsers, or network; failures of underlying infrastructure, including hosting providers, content delivery networks, DNS, or database services; or any partial or complete unavailability of any feature or function of the Service.
zapfood may perform scheduled and unscheduled maintenance at any time. While zapfood will make commercially reasonable efforts to provide advance notice of scheduled maintenance, zapfood is not obligated to do so and shall not be liable for any losses resulting from maintenance activities.
You acknowledge that no software service is entirely free from defects or downtime, and you agree to maintain appropriate contingency plans for your restaurant operations, including the ability to accept orders and payments through alternative means during periods of Service unavailability.
Neither party shall be liable for any failure or delay in performing its obligations under these Terms (other than payment obligations) where such failure or delay results from circumstances beyond the reasonable control of the affected party ("Force Majeure Event"), including but not limited to: acts of God, natural disasters, epidemics, or pandemics; war, armed conflict, terrorism, or civil unrest; government actions, sanctions, or regulatory changes; failure or disruption of internet, telecommunications, hosting, cloud infrastructure, or other third-party technology services; failure or disruption of payment processing systems, banking networks, or financial infrastructure; cyberattacks, including distributed denial-of-service attacks, ransomware, or other malicious activities; power outages or failures of public utilities; or any other circumstances of similar nature.
The affected party shall promptly notify the other party of the Force Majeure Event and its expected duration, and shall use commercially reasonable efforts to mitigate its effects and resume performance.
If a Force Majeure Event continues for more than sixty (60) consecutive days, either party may terminate these Terms by written notice to the other party, without any liability for such termination.
zapfood shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability is limited to the amount paid by you in the one month preceding the claim.
Either party may terminate this agreement with reasonable written notice. We may suspend your account immediately if you materially breach these terms, engage in illegal activity, or fail to pay fees. Upon termination, you may export your data for a reasonable period. After the export period, your data will be deleted except where retention is required by law.
We reserve the right to modify these terms. We will provide reasonable advance notice of material changes via email and through the platform. Your continued use of the Service after the notice period constitutes acceptance of the updated terms. If you do not agree, you may terminate your account.
These Terms are governed by the laws of Finland. These terms constitute a business-to-business (B2B) agreement. Any disputes shall be resolved in the Helsinki District Court (Helsingin käräjäoikeus), unless otherwise required by mandatory law.
